Though the issues of legality, legitimacy, and resistance must be, according to Chomsky, considered in the context of the democratic system, these were not addressed in Court. Chomsky reveals the flawed-nature of America's institutions, observing that if the outcome of this trial were to be taken as a guide of conduct, citizens would have to avoid all public acts undertaken jointly with others who share his views in order to avoid risk of prosecution.
